Cape Town – The National Prosecuting Authority has denied that the case involving Sapho Mahilihili from CPUT had ever been diverted. NPA Western Cape spokesperson Eric Ntabazalila said though an offer was made to divert the matter back in 2016, the accused refused this provision. Ntabazalila’s comments contradict Mahilihili’s assertion, at his court appearance on Monday, that the matter was diverted in April of this year.

There was a warrant authorised on the 23/11/2016 in case number A14/16. According to the charge sheet, the accused was never diverted. The state it seems was willing to divert the matter but the accused was not willing to accept diversion. The matter was postponed to 23/11/2016 for Legal Aid to make representations to the SPP for the withdrawal but the accused never came to court and a bench warrant was authorised.
The SAPS attempted to arrest him, but they could not trace him. They then had the bench warrant converted to a J50 in order to circulate the accused in order to be arrested.
According to the record, the accused was never diverted.
